  • Communications: Information you share when you fill out a form, request a proposal, download a resource, sign up for our newsletter, apply for a job, use our chat, call us, or email us
  • Service Requests: Records of the services you have asked about or requested

Please do not send us sensitive personal information (such as health, financial account, or government ID information) through our forms or chat. We do not need it to respond to you.

If you apply for a job with us, our [Applicant Privacy Notice] explains how we handle applicant information.

Information We Collect Automatically

When you visit the Site, we and our service providers may automatically collect:

  • Usage Data: Pages viewed, time on page, links and buttons clicked, scroll depth, file downloads, site searches, video views, and the path you take through the Site
  • Interaction Data: How you interact with pages and forms, such as starting or submitting a form, and, where enabled and permitted, session recordings and heatmaps that show mouse movements, clicks, and scrolling. We configure session recordings to mask text you type into form fields.
  • Device and Browser Information: IP address, browser type, operating system, screen size, and identifiers stored in cookies or similar technologies
  • Approximate Location: General location (such as country, state, or city) based on your IP address. We use this, among other things, to show you the right cookie banner for your region.
  • Referral and Campaign Information: The website, search engine, or ad that brought you to the Site, including ad click identifiers

Information From Other Sources

We may receive information about you from:

  • Social media and advertising platforms, such as when you interact with our ads or content or submit a lead form on those platforms
  • Business partners, event organizers, and referral sources
  • Publicly available sources, such as company websites and professional networking profiles
  • Service providers that identify the company or organization associated with an IP address, so we can understand which businesses visit our Site

How We Use Your Information

Provide and Improve Our Services

  • Respond to your questions, proposal requests, and chat messages
  • Provide the services and resources you request
  • Review job applications
  • Understand how visitors use the Site, test new page designs, and improve our content and functionality
  • Remember your preferences, including your cookie choices

Marketing and Advertising

  • Send newsletters and updates about our services. You can unsubscribe at any time.
  • Show you ads for our services on other websites and platforms based on your visits to the Site (targeted advertising or retargeting)
  • Measure how well our ads and campaigns work, including whether an ad led to a form submission

Legal and Security Purposes

  • Protect the Site from spam, bots, fraud, and security threats
  • Find and fix technical errors
  • Comply with legal obligations, respond to lawful requests, and enforce our terms

We do not use your personal information to make automated decisions that produce legal or similarly significant effects about you.

Cookies and Tracking Technologies

What Are Cookies and Similar Technologies?

Cookies are small text files stored on your device. We and our service providers also use similar technologies, such as pixels, tags, scripts, local storage, and session storage. In this policy, we call all of these “cookies.”

Types of Cookies We Use

Necessary (always on)

  • Make the Site work, store your cookie choices, keep forms working, and protect the Site from bots and abuse
  • Examples: Cookiebot (consent management), Cloudflare (security and bot protection), Gravity Forms (our forms), and storage that lets interactive features on certain pages work

Preferences (optional)

  • Remember choices you make, such as settings in embedded players and features

Statistics (optional)

  • Help us understand how visitors use the Site so we can improve it
  • Examples: Google Analytics, Microsoft Clarity (session recordings and heatmaps), VWO (testing different versions of pages), OptinMonster (on-site offers and newsletter sign-ups), HubSpot (site analytics), Wistia (video analytics), and analytics tools we host ourselves

Marketing (optional)

  • Let us and our advertising partners show you relevant ads on other sites and measure how our ads perform
  • Examples: Google Ads, Meta (Facebook and Instagram), LinkedIn, Microsoft Advertising, OpenAI (ChatGPT ads), HubSpot ads, and embedded content from X (Twitter)

The full, current list of cookies on the Site, including their provider, purpose, and how long they last, is in the Cookie Declaration below. This list is updated automatically when our cookie scanner finds changes.

How Cookie Consent Works on Our Site

The cookie banner you see depends on your location:

  • European Economic Area, United Kingdom, Switzerland, California, Florida, [and ADDITIONAL U.S. STATES]: We ask for your consent before setting optional cookies. Our consent tool is configured so that optional cookies, and the tags that set them, do not load unless you choose to allow them.
  • All other locations: Optional cookies are on by default. You can opt out at any time using the “Your Privacy Choices” link or a Global Privacy Control signal.

If our consent tool cannot determine your location, it shows the consent-first banner.

Managing Your Cookie Preferences

  • “Your Privacy Choices” link: Use the link at the bottom of every page to review or change your cookie choices or opt out at any time
  • Global Privacy Control (GPC): If your browser sends a GPC signal, we treat it as a request to opt out of the sale or sharing of your personal information and targeted advertising for that browser
  • Browser Settings: Most browsers let you block or delete cookies. Blocking all cookies may cause parts of the Site not to work.
  • Industry Opt-Out Tools: You can also opt out of interest-based ads from many companies through the Digital Advertising Alliance, the Network Advertising Initiative, or Your Online Choices (EU)

Your cookie choices apply to the browser and device you use when you make them. If you clear your cookies or use a different browser or device, you will need to make your choices again.

Do Not Track

Because there is no common standard for “Do Not Track” browser signals, the Site does not respond to them consistently. We do honor Global Privacy Control signals as described above.

Cookie Declaration

Chat, Calls, and Email

Live Chat

Our chat is provided by HubSpot, which acts as our service provider. Chat conversations, including what you type, are recorded and stored so we can respond to you, follow up, train our team, and improve our service. A notice in the chat window tells you this before you send your first message. If you prefer not to have your messages recorded, please contact us by email or phone instead. Some chat replies may be generated by an automated assistant.

Phone Calls

When you call us, our phone systems may collect your phone number, the number you dialed, the date, time, and length of the call, and caller ID information. We use this to respond to you and understand how people find us. [We do not record phone calls.] [Calls may be recorded. If a call is recorded, you will be told at the start of the call.] [If you arrive from an ad or search result, we may show you a unique phone number so we can tell which campaign led to your call.]

Email

Our marketing emails may include tracking pixels and tracked links so we can see whether an email was opened or a link was clicked. You can unsubscribe from marketing emails at any time using the link in each message.

How We Share Information

Service Providers

We share information with companies that help us run the Site and our business and that process information on our behalf. These include:

  • Hosting and Security: WP Engine, Cloudflare, and error monitoring tools such as Sentry
  • Consent Management: Cookiebot by Usercentrics
  • CRM, Email, Forms, and Chat: HubSpot and Gravity Forms
  • Analytics and Site Optimization: Google, Microsoft, VWO, OptinMonster, and Wistia

We require these providers to use the information only to provide services to us, except where they act on their own behalf as described below. Some analytics information is first sent to a server we control and then forwarded to Google.

Advertising Partners

When Marketing cookies are allowed, advertising partners such as Google, Meta, LinkedIn, Microsoft, OpenAI, and HubSpot collect information about your visit (such as cookie identifiers, IP address, pages viewed, and form submissions) directly through their tags on the Site. They may use it to show you ads, measure ad performance, and, under their own privacy policies, for their own purposes.

When you submit a form and Marketing cookies are allowed, we may share a hashed (coded) version of your email address or phone number with advertising partners such as Google so they can match the form submission to an ad you clicked. This helps us measure which ads work. Advertising partners can use hashed information to recognize you, so we treat it as personal information.

Do We Sell Your Personal Information?

We do not sell your personal information for money. However, some U.S. state laws define “sale,” “sharing,” or “targeted advertising” broadly enough to include allowing advertising partners to collect information through cookies on our Site. To the extent our use of advertising cookies counts as a “sale” or “sharing” under those laws, you can opt out at any time using the “Your Privacy Choices” link or a Global Privacy Control signal. If you opt out and we can associate your request with your email address or phone number, we will also stop sending that information to advertising partners, including in hashed form. We do not knowingly sell or share the personal information of anyone under 16.

Other Disclosures

  • Business Transfers: If oHive is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that deal
  • Legal Requirements: When required by law, court order, or government request, or to protect our rights, property, or safety, or that of others
  • With Your Permission: When you ask us to or agree to it

Your Privacy Choices and Rights

Depending on where you live, you may have the right to:

  • Access: Know what personal information we have about you and get a copy, including the categories of information, its sources, why we collected it, and the categories of third parties we disclosed it to, and get a copy

  • Correction: Fix inaccurate information
  • Deletion: Ask us to delete your information, subject to legal exceptions

  • Specific Third Parties: Get a list of the specific third parties to whom we have disclosed your personal information, where state law provides this right (for example, in Oregon and Minnesota)
  • Withdraw Consent: Change your cookie choices or unsubscribe from marketing emails at any time. This does not affect anything done before you withdrew consent.
  • Object or Restrict: Object to or limit certain uses of your information, such as direct marketing
  • Appeal: Appeal our decision if we decline your request
  • Non-Discrimination: Use these rights without being treated differently

To protect your information, we will need to verify your identity before completing access, correction, or deletion requests, usually by confirming information we already have, such as your email address. You may use an authorized agent to make a request for you where the law allows. We may ask the agent for proof that you authorized them and may ask you to verify your identity directly.

We will respond within the time required by applicable law, which is generally 45 days for U.S. state privacy requests and one month for GDPR requests. We may extend this when the law allows, and we will tell you if we do.

Appeals: If we decline your request, you can appeal by emailing privacy@oHivedesign.com with “Privacy Appeal” in the subject line. We will respond within the time required by law. If you are not satisfied with the outcome of your appeal, you may contact your state Attorney General.

We do not collect sensitive personal information for the purpose of inferring characteristics about you, and we do not offer financial incentives in exchange for personal information. How long we keep each category is described in Data Retention.

Providing personal information to us is voluntary. If you do not provide information a form asks for, we may not be able to respond to your request.

You also have the right to lodge a complaint with your local data protection authority, such as your EU member state’s supervisory authority, the UK Information Commissioner’s Office, or the Swiss Federal Data Protection and Information Commissioner.

Data Retention

We keep personal information only as long as needed for the purposes in this policy, unless the law requires or allows us to keep it longer. Our general retention periods are:

  • Inquiries, proposal requests, and CRM records: [X years] after our last contact with you
  • Chat transcripts: [X years] after the conversation

  • Analytics data: [2 or 14] months
  • Session recordings and heatmaps: [X days or months]
  • Security and server logs: [X days]

  • The nature and sensitivity of the information
  • Legal, tax, and accounting requirements

How long each cookie lasts is listed in the Cookie Declaration.

Data Security

We use reasonable administrative, technical, and physical safeguards to protect personal information. For example, information sent to and from the Site is encrypted using SSL/TLS, and access to personal information is limited to people who need it for their work.

No method of transmitting or storing information is completely secure, so we cannot guarantee absolute security.

International Data Transfers

oHive is based in the United States, and our service providers may process information in the United States and other countries. Data protection laws in those countries may differ from the laws where you live. When we transfer personal information from the EU, UK, or Switzerland, we rely on safeguards recognized by those laws, such as the EU-U.S. Data Privacy Framework (and its UK and Swiss extensions) where our providers participate, or Standard Contractual Clauses.

Children’s Privacy

The Site is meant for businesses and professionals and is not intended for anyone under 16. We do not knowingly collect personal information from children under 16. If you believe a child has given us personal information, please contact us and we will delete it.

The Site includes links to other websites and embedded content from third parties, such as Wistia and YouTube videos, X (Twitter) posts, social media links, and review widgets such as Clutch. Embedded content behaves the same way as if you visited the other website, and those companies may collect information about you under their own privacy policies. We are not responsible for the privacy practices of other websites and encourage you to read their policies.

Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated policy on this page and change the “Last Updated” date at the top.
